Can the irs take my refund if my wife is past due on a student loan, but i am the only one who had a w2?
file married/joint but attach a injured spouse form 8379 to the return to protect your refund from being offset.your wife can call 1-800-304-3107 first before you file the form with your return to see if her social security number has even been flagged for her refund to be offset,if it hasn’t then no need to file the form. if you’ll filed already then just mail the form in by itself, and you will get your refund in about 6-8 weeks.
By filing jointly, you linked your income and deductions–and increased your refund by doing so. Just as you link a joint debt, you linked a joint refund. Form 8379 can be filed allowing you to request the IRS to go back and allocate the refund to each of you with you asking for your share to be returned to you.
