Of course they can! I have insurance through The Hartford and as far as I know they are called pre-existing conditions for a reason and they’re usually specified on your policy. So if you are found violating these conditions, then there is a very good chance your policy might get cancelled.

If you had other group coverage for more then one year and it has not lapsed more then 63 days when you come on to the new group plan then no, the insurance companies can not deny claims due to pre-existing condtions. This is called credible coverage and it applies to all insurance companys that offer group health insurance . However if you come on the plan and did not have prior coverage or you did but it has lapsed by more then 63 days then the insurance companies can apply pre-x. Please note though that a company waiting period does not count against you.
