If the lessor accepts rent from the lessee after forfeiture, or does any act which would give rise to the impression that the lessor wants the lease to continue, the forfeiture will be said to have been waived. However if the rent were accepted after the institution of a suit to eject the lessee such acceptance would not amount to a waiver.
