Can the Council close down food businesses which are ‘poor’ and don comply with hygiene standards?

Yes, the Council has the power to close down food businesses, but only if the conditions are poor. We also have the power to serve improvement notices to require businesses to carry out works. The council can also prosecute proprietors of businesses and any employees which break the law. Generally we prefer to offer advice and work with business to help them comply with the law and enforcement measures are only taken if business fail to co-operate, or conditions are so bad we have no choice. See our Enforcement Policy for more accurate guidance to our decision making process.
