Can the cost of the school fees, uniforms, books, extra school activities be deducted from child support?
If a paying parent has below regular care and makes certain types of payments to third parties (including child care costs or fees charged by a school or preschool for a child) is generally able to have those payments credited towards their child support, without the agreement of the receiving parent. Up to 30 per cent of the normal monthly payment can be recognised this way as long as the paying parent pays the other 70 per cent of the normal monthly payment when it is due. This is called a direct payment. The CSA cannot accept or credit prescribed non-agency payments paid on or after 1 July 2008 for paying parents with regular or shared care unless the receiving parent agrees the payment was made in lieu of child support. This is because the paying parent with regular or shared care (at least 14 per cent care or 52 or more nights a year) receives a reduction in the amount of child support they pay because they contribute to the costs of the child(ren) directly through care.
