The Commission cannot institute prosecution without the written consent of the Attorney General and Minister of Justice. Sub section (1) of section 48 provides that no prosecution shall be instituted under this Act without the written consent of the Attorney-General and Minister of Justice. Sub section (1) of Section 36 of the Act provides that where the Commissioner is of the opinion that the findings of the Commission on any investigation warrants consideration by the Attorney-General and Minister of Justice as to whether any criminal proceedings may be instituted thereon, he shall send the report of the investigation to him.
