Dear Liz, If the school district does not follow the IEP that has been agreed upon, it is in violation of the IDEA. Among other things, the decisions about your childs education are supposed to be made by the IEP team, with your involvement. A decision by others outside of the IEP meeting would be inconsistent with this requirement. You could file a complaint with the state department of education, a complaint with OCR, or request a special education due process hearing. You should consult a knowledgeable special education lawyer about the specific issues in your case.
