Can School Nurses follow medication administration orders from a parent?
The Nurse Practice Act permits a licensed RN to follow orders from a licensed provider only. This can be found in Section 6902 of Article 139 Of Education Law, The practice of the profession of nursing…and executing medical regimens prescribed by a licensed physician, dentist, or other licensed health care provider legally authorized under this title and in accordance with the commissioner’s regulations. A nursing regimen shall be consistent with and shall not vary any existing regimen. A parent may alter the insulin orders as prescribed by the provider for the parent to administer. A licensed nurse cannot take orders from an unlicensed person. To summarize the above, a nurse may not take orders from a layperson. The parent may follow the MD orders as written; however the orders do not allow the parent to delegate orders to a licensed nurse.
