Can personal leave be cashed out?
Under the FWA, an employee has the option of cashing out a portion of personal leave if they are the subject of a Modern Award or enterprise agreement which contains a provision allowing for cashing out. This means that it will not be possible to cash out personal leave for award/agreement free employees. The amount of the personal leave entitlement which must remain after cashing out (in the case of award/agreement employees) is not less than 15 days.
