The VA nurse was wrong, likely so was the VA administrator. You get a lot of that at VA hospitals. They used to, and I’m sure some still do, say that no police officer can come on to VA property armed. Absolutely not true. I have also arrested people on VA property. You see being a fed reservation felonies do have to go through the local Assistant US Attorney. They usually refuse prosecution and the local police make the arrest and the local county prosecutes. The police arrest first in most situations and talk with the AUSA after the arrest. It is not a violation of HIPA to give the information on the BAC of someone involved in an accident. This came up so many times that in my state the legislature passed a specific law that calls for the arrest of any hospital personnel refusing to release the BAC.
