Can my spouse / common law partner work in Canada?
Spouses and common-law partners of holders of valid Canadian Study Permits may apply for their own Work Permit without having a pre arranged job offer and without the need for a Labour Market Opinion (LMO) from Human Resources and Social Development Canada (HRSDC). Your spouse / common law partner may apply for a Work Permit at the same time as you apply for your Study Permit. Their permit will be issued “open” or “restricted” depending on whether or not a medical examination was taken prior to issuance. They should complete and submit their own application form for a Work Permit and pay the processing fee for a Work Permit with your application. The spouse’s / common law partner’s Work Permit will be valid for the same period as your authorization to study in Canada. You should provide documentary evidence of your spousal or common-law relationship. Print and complete the Statutory Declaration of Common Law Union – PDF * (97 KB) with your application.
