Can my partners ex wife take his children to live abroad without his permission?
it’s usually in the divorce/seperation agreement that the one with physical custody cannot move the childeren without the other parent’s permission… that’s assuming he has some kind of custody, even if it’s just legal or visitation rights… so she probably cannot do this, but it just may be in their agreement when they got divorce that she can……..
If she is willing to leave the others behind,it looks as if she is not bothered about the rights and wrongs of things,but it all comes down to what the court ruled when she got custody in the first place,did her give up his parental rights,the right thing would be to ask her solicitor for better advice though
Doesn’t sound kosher to me, he better get in touch with his attorney right away. My ex wanted to take my kids to Croatia “for the summer” but I would only let him take one at a time and I had all kinds of legal paperwork drawn up with the time frames that he could have our son. I also told my son that if there was anything told to him that didn’t sound right like they would be staying longer and my son had not heard that this was o.k., directly from me, that he was to go to the nearest US Embassy with a copy of this passport and ask for help. I gave my son a copy of his passport ahead of time and told him to keep it with him at all times, this way, he could prove he was a citizen of the US. Get ahold of a good attorney and good luck!
