Can my neighbor get permanent civil harassment restraining order (already has TRO) without any proof of harassment?
My neighbor (an attorney) is stating that the harassment included making noise (we live upstairs), throwing leaves at her from above (we didn’t do this), and stalking (presumably because of the photos–we have never called her, emailed her, followed her, etc.). We have never seen this person away from our complex. She cites in her declaration that she called in a noise complaint for “disturbing the peace” at 12:30 AM and wrote that the noise lasted for approximately two minutes. We were asleep. We have filed a response refuting all of her false claims, but we are worried that someone this delusional will be able to convince a judge that she is in “danger.” There have been no threats or harassment. We met with an attorney who said she was shocked the TRO was granted in the first place.
