A. Generally, other than where the resident gives one month’s notice or dies, the right to occupy the unit may only be terminated by the obtaining of an order from the Residential Tribunal on the grounds that; i. the physical or mental incapacity of the resident makes them unsuitable to occupy the unit; ii. the resident has breached the Licence Agreement or the Rules and Regulations of the Village and has failed to rectify that breach; iii. Calvary Retirement Community Ryde requires vacant possession of the unit for substantial upgrade of the Village or change of use of the Village; iv. The resident has intentionally or recklessly caused or permitted or is likely to cause or permit serious damage to the unit or injury to the management, an employee of the management or another resident. In the case of ground (iii), Calvary Retirement Community Ryde is required to give the resident at least twelve (12) months written notice of such application to the Residential Tribunal.
