Can my Homeowner’s Association (HOA) deny me permission to install a solar attic fan?

No. Florida Statute, Section 163.04, prohibits HOA’s, covenants, or deed restrictions from prohibiting the installation of a solar, or other renewable energy device on the property owner’s buildings or land. Your HOA can request you to place the solar device in another location that is within 45 degrees of true south (which is the optimal orientation), as long as the request is consistent for all installations under their authority.
