Yes she definitely can, if the child was actually born then no. But it would be very hard for your brother to try to go to court now and get a custody order being that #1 the child isnt born yet, meaning how can anyone be sure that it is his child. Once the child is born, your brother can definitely take her to court for custody but if he does I am sure that she will retaliate with a Child support order and your brother is going to be obligated to pay.
