Can income from the successful exploitation of IP be retained by a Trust or PCT?
• Yes, IP will only be developed within the Framework Guidance if it can generate income, and this income will be retained by the Trust in line with wider-Government policy. However, this retention of income must be in line with the way that the NHS manages its funding and this is set out in the Framework and Guidance. The inventor will not be expected to contribute to the costs involved, it is the Trust or the PCT, which takes this risk. It is for this reason that the inventor only takes a portion of the income.
