Yes, one can sue for any reason under the sun.

Is it wise? No, unless you find a lawyer who will take the case on a contingency basis (personal injury, class action, etc.)

Since this involves a criminal charge, the chances of you finding a lawyer to take it on a contingency basis (lawyer gets paid if you win and court awards damages) are very slim.
