You can’t claim in the Employment Tribunal because you’re out of time. The only claim you could possibly have is a personal injury claim for what is colloquially known as ‘stress at work’. It’s actually injury at work and not really anything to do with stress. The key tests are set out in the case of Hatton (link below) but the central test is that the conduct of the employer must be such that they know, or ought to have known, that their conduct/actions would cause you injury. Not merely stress – actual psychiatric injury. There are a number of other hurdles too. They are VERY difficult claims to win. You need to run all the facts past a credible PI lawyer (not the monkeys on the daytime telly ads) – I can suggest one if you need a pointer (it’s not me).
