The unfortunate answer is yes if you are in the U.S. Unfortunately, our court system allows for anyone to sue for anything at anytime. Frivilous lawsuits generally get thrown out pretty quick though and leave the original party at risk of a lawsuit. I seriously doubt you want to go through a year (possibly two years) to fight this case. Most states have “at will” employer laws. This means you can be fired for any reason without notice and your boss would most definately be gunning for you if you went that route. Others may paint a target on you as well. Take a different approach….. More than likely you just need to go tell him the language is offensive to you. If he is a jerk about it, or you feel he would be, feel free to go to see an equal opportunity person at you place of employment or go to a supervisor just above his level.
