Can I sue her for rental car expenses?
Late last year, I was rear-ended on the freeway, causing damage to my car. CHP came and took a report, finding the other driver at fault. Everything was proceeding normally through insurance until the other driver’s insurance company declined to cover her. I believe that it’s because she was a 19 year old girl who used the car as her personal vehicle (I recall that it had a sorority license plate frame and/or stickers, and other “accessories” that made it look like a younger girl’s car), but the car was registered to and insured under her Mom’s name. So, I speculate that they were trying to keep their costs down on insurance, and got caught. Regardless, their insurance isn’t paying the claim. Her insurance company sent me a letter stating that she was not covered for the accident, which I forwarded to my insurance company.
