Can I sue a used car dealership and win for selling a death trap?
Unless you happen to be within the very short period (days) a handful of states afford used cars buyers (invariably for vehicles ABOVE a certain value), you’re only remedy would be based on the dealer failing to disclose anything about the vehicle the state may require, like the car may have been salvaged, flood damage, etc. or if the dealership committed some sort of overt fraud (it had tampered with the odometer, swapped VIN plates, etc). If the dealer didn’t provide an explicit written warranty, none exists. Otherwise, you’re certainly at liberty to sue, for the money involved (which will be relegated to a small claims venue), and the only damages you may seek is the money you spent. Your likelihood of success, however, is nil.
