Can I sew governmet agency for distroing my business by neglegent regulation ?
First let me state that I am not an attorney, and you should therefore take my answer with a huge grain of salt. To my knowledge, in most cases, it is nearly impossible to sue a government agency for negligence. The rare exceptions usually deal with gross negligence or individual corruption. The U.S. and its states have a long history of governmental immunity which protects public agencies and officials from being sued by the people they represent. You will sometimes hear of a successful case against a transportation agency for negligent road design or construction that led to a traffic accident, but these cases, too are very hard to win. On the other hand, while you may not be able to win damages for negligence, you might be able to get a court to rule a specific policy violates your rights under the state consitution or state law. I suggest you talk to an attorney in your area for a better understanding of what your options are.
