Can I request paternity test from ex girlfriend before child is born so that as soon as child is born she has ?
You need to wait until it’s born and then go to the courts an file for a paternity test. She can have one one before then via amniocentesis, but it’s highly invasive and can be dangerous to the baby. Chances are, you will get rights. Visitation for a while, they will not take a child away from the mother until at least a year. But I would wait until after and go to the courthouse. Go ahead and find a lawyer if you’d like. By the way, if you want to file for rights via paternity test a judge will always grant the father rights as long as he doesn’t see anything that could potentially harm the child. Courts go in fathers favors if they are willing to be there.
From the language in your question, I’m going to assume you are in the United States. If not – disregard what I’m saying, because laws differ in other countries. First of all – DO NOT WAIT UNTIL THE CHILD IS BORN! Most people have said that you need to wait before you file for paternity. That is absolutely, 100% the wrong answer. If you do that, she can disappear on you, and good luck tracking her down. She could also give the baby up for adoption, and if you don’t find out quickly enough, you could lose all rights to the child by default. Many states have putative father registries. What happens is that you give the state the name, address, and approximate due date of the woman you think is carrying your baby. Then, when the baby is born, the state does a paternity test. If you’re the father, your name goes on the birth certificate. Then you are required to pay child support and are eligible for visitation.
You sound like stand up guy. Good job! The best thing you can do is to take child support out on yourself as soon as the baby is born. The reason for this is because for the next 18 years she can take you to court and request it so you might as well do it now. The department of human services usually handle this. Contact them for an application. Once they get started they will set a date for you, her and the baby to come in for a paternity test. A few weeks later the results will come and a court date will be set. At court you will determine how much child support you will pay well as visitation. They usually don’t put visitation in the court order unless you request it so be sure to do that. If she denies you the right to see your child after the judgement in court then she can be put in jail for violating. I wish you the best!
I don’t know what state you’re in, but you cannot in CT. Unless she goes after child support, you’re going to pay through the nose to even get the test because she doesn’t even have to do it unless a judge orders it. I guess your best move right now is to start saving money to do what needs to be done.
