Can I participate in both the Partner Program, the Google eBookstore and the Amended Settlement?
Yes. You can choose to participate in the Amended Settlement and its revenue models for one or more Books even if you participate in the Partner Program or the Google eBookstore. The Partner Program agreement, if applicable to a particular Book that is also included in the Amended Settlement, will govern Google’s treatment of that Book to the extent the Partner Program offers the same uses or revenue models as the settlement and any prohibitions imposed by the Partner Program agreement on Google’s uses will apply. You can also choose to have Google sell electronic versions of your books in its eBookstore by contacting Google directly. Again, your agreement with Google to make your book available through the eBookstore will prevail over the terms of the Amended Settlement.
