No. All work in a fixed payment case is covered by the core fixed payment and any further fixed payments arising in the circumstances of the case. If there is no fixed payment prescribed for the specific work in question it is included within the core fixed payment which specifically covers ‘any subsequent or additional work other than that specified in paragraphs 2-9’. References under the Scotland Act which arise during the course of a fixed payment case will not be subject to fixed payments. It will be possible to submit both a fixed payment claim and a time and line account in such a case.
