Can I file in small claims and place a lien on the same day?
I assume you want to file a mechanic’s lien for work done and materials supplied. It is a stronger lien than a small claims judgment and has some real teeth in it. It gets a bit complex due to differences between states and fairly stringent requirements for the process itself. Things have to be done in a certain order and within certain time limits. You need a lawyer’s advice on this one to get everything right. Taking the client to court to “perfect” the lien is done later in the process. I am not sure but I don’t think that step is done in small claims court. Again, seek legal advice–especially since you sound like a first timer.
