Can I file a civil suit against someone for filing a false police report against me if the DA never pursued charges against them for doing it?
The criminal conviction, even though it was a misdemeanor, would make it extremely difficult to win a civil judgement against those you accuse of filing a false police report. Moreover, it would be difficult to prove that the people filed a false police report unless you have evidence to substantiate your claim, viz.: some type of admissible confession. Even though the standard in a civil action is by preponderance of the evidence, which is a less stringent standard then beyond a reasonable doubt, that standard will work against you in light of the facts contained in the background to your question.
