When you call the police for a domestic violence case, the police take it very seriously. The police are supposed to arrest the person and remove them from the home. However, if the person being arrested resists, the police can use reasonable force to place him into custody. As far as dropping the charges once you report them, the state will not do this unless the family violence counsellor that you meet with feels and recommends to the state’s attorney that this man is no longer a threat to you and that they do not need to pursue the charges. If you do not want this person in the home anymore, the state is going to ask for a protective order to be in place and pursue a conviction. Even if you do not testify, the state can still win at trial based on their observations and statements made by you upon their arrival, including your actions.
