Neither of you can file as Single. He MUST amend his return. You can file as Married Filing Jointly or Married Filing Separately. Since you’ve only been separated for 6 months, neither of you can file as Head of Household. To file as HoH, you must not have lived together at any time after June 30, 2008, among other requirements.

Dear S: Married jointly is the best if you can get together with hubby. The law is if you have not lived together the last 6 months of the year you can be considered unmarred for tax purposes allowing the person who has custody of a child to file as HOH. Never single! You both can recall your returns by filing jointly (1040X), but remember the refund check comes in both names.
