No. The Necessary Expense Rule allows us to incur expenses which are necessary/proper/incident to the proper execution of the object [of the appropriation], UNLESS the expenditure is otherwise provided for in another appropriation. The expenditures in this case (command ball caps), are already provided for in the Military Personnel Navy (MPN) appropriation. That appropriation reads, “For…clothing…for members of the Navy on active duty (except members of the Reserve provided for elsewhere), midshipmen, and aviation cadets.” Because clothing for Navy personnel is specifically provided for in the MPN appropriation, such costs cannot be justified under the Necessary Expense Doctrine. DON personnel receive money to buy/replace their ball cap. The Uniform Regulation states that the useful life of a NAVY ball cap is 12 months. Personnel receive an annual cash allowance to replace such hats. Appropriated funds can not be used to purchase command ball caps because those items are already sp
