Can I build a home on a lot I own if it is located in the Special Water Resource Protection Area (SWRPA)?
One single family home may be constructed on an existing lot in a SWRPA if it is not part of a larger development, the lot received preliminary or final subdivision approval on or before February 2, 2004 and construction of the home begins by February 2, 2009. However, such activities may be regulated under the Flood Hazard Area Control Act rules and may require an approval from the Division of Land Use Regulation.
