Can I be held liable for propping open the pool entrance gate?
Yes, you could be party to a lawsuit in the event a small child wanders into the pool area without a guardian and subsequently drowns. All who use the pool swim at their own risk as indicated by signs posted at the pool. Heritage Park does not employ lifeguards. It is in the best interest of homeowners–whose monthly assessments pay for pool maintenance–to close the gate whenever they see it left propped open by another resident. Additional wear and tear of the pool, pool furniture, and the cabanas by non-residents and by homeowners behind on their monthly assessments only serves to increase Association dues the following year. Such wear and tear may even require that the Board levy a special one-time assessment to all homeowners to cover unanticipated pool costs that are well in excess of our budget allocation.
