Can I appeal a functional capacity exam (FCE) rating if it seems wrong?
• A: If the results of your FCE test seem wrong to you, go over them with your doctor. The FCE is often thought of as a fair assessment of an injured employee’s condition, since it’s supposed to be an objective test not subject to interpretation. That means, basically, any doctor should be able to read and agree with the results. If you and your doctor still don’t agree with the results, you may request another exam. However, don’t be surprised if the workers’ comp insurance carrier refuses to pay for the second exam, leaving you to the foot the bill. You may want to talk to an attorney for help in getting the insurance carrier to pay for the second exam.
