Can I add a shed, a swimming pool or a garden in the Special Water Resource Protection Area (SWRPA)?
Improvements that disturb less than an acre of property or result in the less than ΒΌ acre of impervious cover are not regulated by any portion of the Stormwater Management rules, including the SWRPA. As stewards of the environment, the Department encourages property owners to locate these improvements outside of the SWRPA if at all possible. However, such activities may be regulated under the Flood Hazard Area Control Act rules and may require an approval from the Division of Land Use Regulation. Please refer to Section 11.0, Division of Land Use Regulation Review for more information.
