He need not to file second petition. But he may rightly file an affidavit along with SET ASIDE petition [interlocutory application] to restore the case along with another petition under section 5 of Limitation Act to condone the delay TO RESTORE THE dismissed case. If court condones the delay [usually impose some cost], petition may be allowed. Because of matrimonial matter, court strictly view the set aside application, set aside only upon valid grounds.
