Can hospitals in the U.S. Territories qualify for the Medicare and Medicaid EHR Incentive Program?
Hospitals in the U.S. Territories cannot receive incentive payments under the Medicare EHR Incentive Program. For the purposes of the Medicare EHR Incentive Program, the Social Security Act defines an eligible hospital as a “subsection (d) hospital” that is located in “one of the fifty States or the District of Columbia.” This does not include hospitals located in the U.S. territories. Therefore, hospitals in the U.S. territories do not qualify for the Medicare EHR Incentive Program. However, under the Medicaid EHR Incentive Program, hospitals located in the U.S. Territories are eligible to participate in the Medicaid incentive program as long as they meet all other eligibility requirements.
