Can hospice inpatient days be used as the three day qualifying stay for Skilled Nursing Facility (SNF)?
Section 1861(i) of the Act provides that to be covered under Part A, inpatient care in a SNF must be preceded by a qualifying hospital stay of at least 3 consecutive days (not including a day of discharge). Section 409.30(a) of 42 Code of Federal Regulations (CFR) further specifies that the stay must have been in a participating or qualified hospital for medically necessary inpatient hospital care. Thus, there is no policy that would prevent a hospital stay that is covered under the hospice benefit from serving as the required 3-day hospital stay to establish eligibility for coverage of SNF care.
