They sure can. Child support has become a “bill” in today’s society. It is a financial obligation, and just like any other financial obligation it is due and payable by any means possible. When using an estate to pay off the deceased bills, in the heirarchy of things secured debts get theirs first. Meaning if the deceased owned a house, boat or car, the bank that the loan/mortgage is through gets first dibs to sell the property and any profit after they get theirs is given back to the estate to pay other debts. Next unpaid taxes and other gov bills that are owed get theirs. Next is back child support owed to the state as repayment of public assistance. Then back child support that is owed to the other parent and not the state. Then med bills, credit cards, electric/gas bills, phone bills, things like that.
