1) Third party copyright material cannot be released under an OER licence without the copyright owner’s permission. Therefore, if a resource which contains both “self IPR” and third party IPR is put up on JorumOpen purportedly under a single CC licence, if the owner of the third party copyright hasn’t given permission for a CC licence, then users cannot legally use that third party material. There are two possible exceptions to this – the user may be able to use a statutory exception in limited circumstances (e.g. for examination purposes), or the user may have his or her own licence which allows use of the resource (e.g. it was an ERA-covered recording of a broadcast, and the user has an ERA licence). In any event, putting someone else’s stuff into JorumOpen in itself is likely to be an infringing act (unless the depositor has permission or a licence to do this).
