Yes. Either party involved in expropriation proceedings can request the services of the BON. In most cases, it is the expropriating party that requests the services of the BON. As well, section 26 of the Expropriations Act requires that both parties agree to bypass the option of mediation before proceeding with an appeal to the OMB.
