Yes, if an appeal is withdrawn after an inquiry or hearing has been arranged or if, in the case of enforcement and lawful development certificate appeals (regardless of type of procedure), it is withdrawn at any stage in the proceedings. Costs applications should be made in writing to the Assembly’s Planning Division within 4 weeks of receiving the Inspectorate’s confirmation of the withdrawal. The decision is taken on behalf of the National Assembly for Wales – not by an Inspector – after an exchange of written costs correspondence.
