Yes. As the AHR Act is not retroactive, AHR clinics may continue to use any sperm they had in storage prior to April 22, 2004, even if it was provided by a paid donor, so long as they meet the other requirements of the AHR Act (for example, section 71; section 8, Consent to Use; etc.).
