Legally, the Courts cannot garnish more than you owe. Other than that, they can pretty much do as they chose. You will find that most judges are very fair, but will also put punative measures in place if you do not face up to your obvious obligations. You can’t really blame them, what sort of parent tries to avoid providing adequately for their own child? If you take documentation to your hearing that clearly proves your income & your expenses, you can reasonably assume the Court will be “fair”….you can also assume that the more respectful you are, the “fairer” they will be!
