Can Big Payer simply state that they are now both a Clearinghouse and Payer and “get around” the requirements that way?
It is my perception that there are several payers out there who plan to continue to accept HCFA1500’s flat files, NSF, and UB files. These payers state that they will re-format the claims for the providers to a HIPAA compliant standard. Obviously, unless the HIPAA-police investigated, no one would be the wiser as to whether the payer actually reformatted the claims or not.
