Can arbitration awards be appealed?
As a general rule, no. Recently, however, attorneys have attempted to insert provisions in arbitration contracts providing for appeals of awards to a court. Whether or not such appeals will be permitted by appellate courts has yet to be fully explored. The idea of building into a contract an appeal mechanism for a process that was intended to be final and conclusive is something the parties may want to discourage. If speed, cost, and finality are important considerations, then continuing the dispute through appeals may not be consistent with the underlying purpose for submitting the dispute to arbitration in the first place.
