Can any doctor declare a patient to be brain dead?
Criteria differ from state to state, and hospital to hospital. Although any physician can legally make this declaration, it is best done by a Neurologist or Neurosurgeon or by a physician who is very familiar with the protocols and proper means of testing, in order ensure that a patient who appears brain dead is actually brain dead.
