Can an unlicensed bldg. contractor file a mechanics lien legally?

0

I,m licensed contractor and have been working w/a guy for 4yrs, we wre splitting jobs 50/50. He paid me checks, cash and 1099 me 4yrs ago. The last 2yrs most jobs were in my name. I always wrote him checks and 1099 him. The owner on our current and last project wrote checks out to both of us seperetly. With 1 1/2 months left on project the owner with held the remaining 10% until completion of the house we were building. This was fine with me but the other guy wasn,t happy creating alot of tension with owner. THe owner and I decided it was best he did not finish job so I told him I would be completing rest of job and figure out payment after all cost of job was done.SInce finding out he was unlicesened I no longer will be doing work w/him.Since than he filed lien for more then is owed him.
