Can an individual refuse field sobriety tests?
Yes. Unlike the blood, breath or urine tests taken after you have been arrested for DUI, you can refuse to take a FST without fear of legal repercussion and it is probably in your best interest to decline such tests. These tests are extremely subjective and designed for failure. Most likely, the officer has already decided to arrest you. Don’t give the officer any more evidence to use against you later.
