Can an Appointor receive income from the trust?

0

Under the Hybrid Trust deed that you are drafting the class of General Beneficiaries includes Appointors and Trustees. Under the trust deed you can make distributions to any General Beneficiary. As the current Appointors and Trustees are also General Beneficiaries then, yes, you can distribute income to them. As with any Beneficiary the Appointor will tell the Trustee who gets what income and capital. This can change each year. The Appointor can direct that all, none or some of this year’s income will be distributed to the Appointor or anyone that the Appointor wants. Under the trust deed you can also employ the Appointor and Trustees (this is provided that the law allows this).
